Cancellation of studio or photographer bookings

CANCELLATION POLICY FOR STUDIO RENTAL / SELF-SHOOT / ON-LOCATION PHOTOGRAPHER

For cancellations made less than 24 hours before the studio booking begins, the full amount will be charged.

For cancellations made less than one week before the studio booking begins, half of the amount will be refunded.

For all other cancellations, a fee of DKK 500 will be charged.

Payment

We accept payment cards and MobilePay.

Delivery terms

We aim to deliver images as quickly as possible and no later than the ordered number of working days after the products have been received, unless otherwise agreed.

Complaints and right of withdrawal

• Customers have eight days after image delivery to submit correction requests or complaints concerning their order.

• Errors or omissions caused by Trendshots in carrying out the order will be corrected free of charge as soon as possible.

• No full or partial compensation is provided where an order was based on incomplete directions or instructions; related corrections will be charged at the applicable rates.

• Once products have been received, ordered services cannot be cancelled and the customer remains liable for the full order amount.

Terms of sale and delivery for Trendshots

These terms of sale and delivery apply between the customer and Trendshots unless expressly varied by agreement between the parties.

1. Quotations and agreement
1.1 A quotation is binding on Trendshots for 60 days from its date.
1.2 An agreement is concluded when Trendshots receives the customer’s acceptance.
1.3 If the customer does not provide an express acceptance, the agreement is concluded when Trendshots issues an order confirmation for the order received.
1.4 The quotation is conditional on the materials and processes being suitable for machine processing as assumed in the quotation.
1.5 The customer may not require delivery in separate instalments instead of the single delivery stated in the quotation, and the material supplied by the customer must correspond to the basis of Trendshots’ quotation.

2. Price
2.1 All prices exclude VAT and delivery.
2.2 If wages, material prices, public charges or other costs increase before Trendshots completes the delivery, Trendshots may adjust the price by the documented increase.
2.3 If those costs decrease before completion, the customer may require a corresponding documented price adjustment.
2.4 Prices in foreign currency are based on the Danish-krone exchange rate applicable on the date of the quotation or order confirmation.
2.5 Trendshots may adjust the price to reflect exchange-rate changes before payment.
2.6 In addition to the quoted or agreed price, Trendshots may charge for extra work caused by incomplete, unsuitable or defective source material; corrections or changes requested after work has begun; more proofing rounds than agreed; overtime or other measures agreed after conclusion of the agreement; storage, release, handling and shipment of the customer’s digital or physical material and tools after delivery; and interruptions to continuous production caused by the customer.

3. Delivery
3.1 Delivery takes place at the agreed time, subject to delays or obstacles caused by the customer’s act or omission or by the circumstances listed in clause 8.1.
3.2 In such cases Trendshots is entitled to extend the delivery period or terminate the agreement.
3.3 If such an event increases Trendshots’ cost of fulfilling the delivery obligation, Trendshots must fulfil it if the customer agrees to pay the additional amount calculated by Trendshots.
3.4 If no delivery time has been agreed, Trendshots determines the delivery time.

4. Payment
4.1 Payment is due on the date stated in the quotation, order confirmation or invoice, or in cash on delivery if no due date is stated.
4.2 Interest accrues from the due date at Trendshots’ current rate, presently 10.75% per year.
4.3 The customer must provide a bank guarantee for payment whenever requested by Trendshots. If requested after the agreement is concluded, Trendshots will indemnify the customer for any related expense.

5. Ownership and copyright
5.1 Copyright in photographs, concepts, creative proposals, original material and similar work developed by Trendshots belongs to Trendshots and may not be transferred to a third party without Trendshots’ approval.
5.2 Copyright in delivered material remains with Trendshots until all invoiced amounts have been paid or otherwise agreed. In insolvency, Trendshots may recover unpaid amounts from a third party that has used the material; the customer must communicate this condition to the third party.
5.3 Intermediate products, materials, tools and similar items created or procured by Trendshots for the delivery remain Trendshots’ property, whether or not separately invoiced.
5.4 The material referred to in clause 5.2 may be used only for work for the customer and will be stored only by separate agreement.
5.5 Trendshots may use material it has produced as references and for marketing without obtaining the customer’s consent.

6. Delay
6.1 Subject to clause 3.1, the customer may terminate for delay only if, when concluding the agreement, the customer expressly stated that delivery at the exact agreed time was essential.

7. Defects, complaints and right of withdrawal
7.1 Trendshots is not liable for errors that the customer failed to correct in writing in proofs, including print, digital information, test prints or similar material.
7.2 The customer is deemed to have finally approved the product if it is used by the customer or a third party.
7.3 The customer must complain about a defective delivery without delay. If a complaint is omitted or made too late, the right to rely on the defect is lost. Trendshots may remedy a defect within a reasonable period, normally eight working days.
7.4 A complaint does not suspend the payment obligation, regardless of its scope, cf. section 18(4) of the Danish Consumer Contracts Act.
7.5 Errors and defects caused by Trendshots in carrying out the order will be corrected free of charge within a reasonable period, normally eight working days.
7.6 No full or partial compensation is provided where instructions were incomplete; related corrections will be charged at the applicable rates.
7.7 Once products have been received, ordered services cannot be cancelled and the customer remains liable for the full order amount.

8. Liability
8.1 Trendshots is not liable for delay or defects caused by faults in or damage to production equipment demonstrably affecting production; labour disputes; a subcontractor’s delay or failure; fire, water damage, natural disasters, war, mobilisation, requisition, seizure, unrest, currency restrictions, lack of transport, general shortages, energy restrictions, export or import bans, or comparable circumstances beyond Trendshots’ control.
8.2 The same exemption applies where delay or defective delivery is caused by a circumstance listed in clause 8.1 or cessation of the business.
8.3 Trendshots is not liable for the customer’s operating loss, loss of profit or other indirect loss.
8.4 This includes losses arising from the customer’s legal relationship with third parties; see, however, clause 8.4 in cases of delay or defects in the delivered material.
8.5 Trendshots is not liable for loss of or damage to property such as originals or materials owned by the customer and entrusted to Trendshots for an assignment or storage, including work performed by Trendshots, unless gross negligence by Trendshots or its personnel is proven. The customer must arrange insurance against damage and loss.

9. Subcontractors
9.1 Trendshots may have work performed wholly or partly by subcontractors.

10. Recurring publications and continuing contract work
10.1 Unless otherwise agreed, recurring publications and continuing contracts may be terminated with three months’ notice.

11. Danish law
11.1 Danish law, including the Danish Sale of Goods Act, applies where the agreement or these terms do not otherwise determine the legal position. Any dispute concerning interpretation, performance or enforcement may be brought only before the Danish courts under Danish venue rules. Questions may be sent to info@trendshots.dk.
